Basic Facts About H-1B Visa
The H-1B visa is a non-immigrant visa. The U.S. employer is the petitioner and the foreign worker is the beneficiary. There are only limited numbers of visa each year determined by Congress. Once approved, it allows U.S. employers to employ foreign workers to work in the U.S., and the foreign worker can legally live and work in the U.S. for a total of 6 consecutive years. The employer can sponsor the foreign worker for a green card. While being in the U.S., the worker’s spouse and children can live with him or her here (H-4 visa). But they cannot work in the U.S.
The minimum education requirement is bachelor’s degree, however, one can satisfy it with a 3-year degree (Associate degree) and 3 years of experience preferably in the same field as the major. The occupations that qualify for the hiring of a foreign worker are generally the ones require higher learning and specialization, such as computer science, IT, engineering, scientific research, mathematics, architecture, biotechnology, biology, physiology, theology, medial research, social/educational research, arts, performing arts, business, finance, sales/marketing, accounting, banking, recruiting, and law.
